I came across this at the Small Press Center website:

"Publishers Weekly" has reported in their August 8th issue that Lev Tsitrin, author of The Pitfall of Truth, is suing the Library of Congress over its rule that a publisher must have published the work of at least three different authors before it's _title_s will be included in the Library's catalogue. Tsitrin contends that he is suing The Library in the U.S. Court of Federal Claims, because the three-author requirement is a violation of his First Amendment rights. The Library of Congress explains, on it's website, that it does not have the resources to catalogue every self-published release and limits itself "to works most likely to be widely acquired by U.S. libraries."
